Criminal Procedure.

By virtue

of

the powers vested in the Military Government

of Santo Domingo, the following Executive Order is hereby pro-

mulgated

:

ARTICLE

1.

Article

94

of the Code of Criminal Proced-

ure, as amended, is hereby amended

by

adding the following at

the end thereof:

“When an accused has been imprisoned under a detention

order

as

herein provided and has continuously remained in con-

finement for a period of time, that in the opinion of the Procura-

dor

General of the corresponding Criminal

Court

would equal

or

exceed that of the penalty that should be impxed upon convic-

tion,

it

shall

be

the duty of the Procurador General to certify the

facts to the President of the Court of Appeal with appropriate

recommendation. The President of the Court shall appoint one

of the other judges of the Court who shall forthwith direct the

suspension or continuance

of

the detention order. Should an

accused, released

by

virtue

of

such suspension, fail to appear for

trial for which

he

shall

be

legally summoned,-judgment by def-

ault shaB

be

entered against him”.

ARTICLE

2.

All laws

or

part of laws in conflict with this

Order,

are

hereby repealed.
